Purpose and access
OAM stands for Officially Appointed Mechanism and is the Danish Financial Supervisory Authority’s (the “DFSA”) portal for reporting and storing information in accordance with the applicable capital markets legislation.
OAM also functions as a collection portal in accordance with the ESAP legislation. ESAP is the European Single Access Point and shall provide the public with easy and centralised access to information about entities and their products relevant to the financial services, capital markets, sustainability and diversity. Users can access the OAM using the available login methods. Users must follow the instructions set out in the in above-mentioned guidance documents and are responsible for ensuring that all registered information is correct and up to date. Login credentials must be kept confidential, and access to OAM must not be granted to unauthorised persons. In the event of suspected of misuse of login credentials, powers of attorney or access to OAM, the Danish Financial Supervisory Authority (the “DFSA”) must be contacted as soon as possible.
Users access, use and reuse publicly available information in OAM, including notifications submitted by the issuers and certain short-selling notifications, at their own responsibility and in accordance with the legislation in force at any given time. The DFSA shall not be held liable for any infringement of third-party rights by users.
Users must not use OAM to obtain unauthorised access to information, circumvent the system’s security measures, damage the underlying infrastructure, place an undue burden on the system, or otherwise interfere with its functionality or operation.
The DFSA endeavours to ensure the stable operation of OAM and to comply with applicable minimum standards for IT security with regard to the information reported but does not guarantee uninterrupted or error-free access. It may be necessary to temporarily restrict or interrupt access to OAM, for example due to technical problems, updates, maintenance or other operational circumstances.
The DFSA is not liable for loss or damage caused by a lack of or restricted access to OAM, including as a result of operational disruptions, technical errors, updates or maintenance. The Danish Financial Supervisory Authority cannot be held liable for loss of data stored on the user’s or a third party’s equipment, or for indirect loss, unless the loss is caused by the Danish Financial Supervisory Authority’s intentional or grossly negligent conduct.
Submission of notifications via OAM
Users can submit notifications via OAM. Information about how to submit a notification is available in the Guide to login and submission of notifications in the OAM. Additional information about reporting obligations and diffent types of notifications is available on the DFSA’s website and FAQ.
Users are responsible for the completeness and accuracy of the information and that such information is submitted within the deadlines.
The DFSA may reject information submitted by the user or remove information made available in OAM if such information is manifestly inappropriate, abusive or outside the types of information that may be reported to OAM.
When reporting under the ESAP rules, users are also, pursuant to the ESAP Regulation, responsible for the relevant accompanying metadata and for notifying the DFSA if the report contains personal data. The DFSA will then forward the report to ESAP as the designated collection body.
The DFSA’s use, further reuse and storage of the information made available to ESAP are subject to EU rules, including the ESAP Regulation and the related delegated regulations and technical standards.
Under those rules, the use and re-use of the information made available to the ESAP by the collection bodies shall be subject to the conditions of the Creative Commons public domain dedication (CC0) or any equivalent open licence allowing for unrestricted use and re-use of data. That is without prejudice to information covered by copyright and other related rights, the use and re-use of which shall be governed by the conditions of the Creative Commons Licence BY-NC-ND or any equivalent open license.

The OAM Privacy Policy must be read together with the DFSA’s general privacy policy and the privacy policies regarding persons discharging managerial responsibilities and persons closely associated with them and major shareholdings.
