The temporarily lowered notification threshold for net short positions in European shares will expire

Effective from 20 March 2021, the normal 0.2 percent notification threshold for net short positions in shares will come back into force. The European Securities and Markets Authority (ESMA) has on 15 March 2021 decided not to renew its decision to temporarily lower the notification threshold to 0.1 percent for net short positions in shares traded on regulated markets within the European Union.

The temporarily lowered notification threshold introduced by ESMA on 16 March 2020 requires short sellers to submit notifications of their net short positions when they reach, exceed or fall below 0.1 percent of issuers’ issued share capital. Please find last year’s press release regarding the introduction of the lowered threshold here.

With ESMA’s decision, the temporarily lowered notification threshold will expire after 19 March 2021. This means that the last reporting where the lower threshold of 0.1 percent applies will be in relation to positions as of Friday 19 March 2021, and must be reported to the Danish FSA by 15:30 CET Monday 22 March 2021.

From 20 March 2021 onwards, position holders will need to submit notifications only if their net short positions in shares reach, exceed or fall below 0.2 percent of issuers’ issued share capital. Any outstanding net short positions below 0.2 percent, but at or above 0.1 percent, will not have to be reported.
